MINUTES OF JUNE 9, 2003 MEETING


A.    Call to order

Chairman Metzler called the meeting to order at 7:37 p.m.

D.    New Business

1.  File #W2003-26 – Application for construction of garage and kitchen addition in a
    regulated area on property located at 35 Fermier Road (Map 40, Lot 8A, 10.47 acres).
    Owner/Applicant:  Robert Whalen (Received 6/9/03, No Decision before 6/23/03,
    Public Hearing or Decision by 7/28/03.)

Bruce Hice, Contractor, said the applicant is looking to put in a garage adjacent to the house and kitchen addition.  

Metzler commented that there is a 100 ft. upland review area from the edge of the wetlands.

Yorgensen said the regulated area would be 250 ft. from Stiles Brook, and explained the regulations.

In answer to questions from Chairman Metzler, Mr. Hice said only the first 220 ft. of the driveway was paved, that curtain drains were around the garage, and that a footing will be poured.  He also said the garage will have a slab floor and there will be excavation around the area of the garage but that there will be no stockpile.  He said the substrate will be gravel.  He said the distance from the wetlands will be about 50 ft., the distance from the brook well over 200 ft.

Yorgensen said that Assistant Agent Jones went to the site.

MOTION:  To remand Application #2003-26 to staff.

Discussion.  Metzler said he would like to see a report from Agent Jones from the site inspection.

E.    Old Business

1.  File #W2003-22 – Application for a driveway crossing in the wetland area on property
    located on easterly side of Mason Road (Map 6, Lot 14, 10.06 acres).  Owner:  Eugene
    and Stephen Wasynczuk; applicant:  Bruce Pittman.  (Received 5/12/03; No decision
    before 5/26/03; Public Hearing or Decision by 7/14/03.)

Mr. Mihok said this lot was approved in 1978, and that the house site was up front.  The wetlands were not flagged at that time.  He said they propose to use the large upland area at the rear of the lot for the dwelling.  He said they are proposing a driveway in the least significant part of the wetlands.  He said they will surround the culvert with large rip-rap.
He said they will minimize disturbance of the wetlands with this proposal.  He said the driveway will either by 12 ft. or a little wider for fire truck access.

Metzler asked if the culvert locations were defined, and Mr. Mihok said the existing road traverses the road pretty much in the middle.  He said he has soil maps that show the actual wetland.  He said that 350 cu. yds. will have to be removed.  

Metzler said that Karl Acimovic will have to provide a review and a site walk will have to be done.  

Yorgensen asked if the applicant has gone to the Health Department with this, and Mr. Mihok replied that this was done before the Health Department existed; therefore, the Health Department has not reviewed it.  He said that test pits were done with Steve Jacobs.  

Metzler said that we should do our review and have a site walk.  He said that we are required to look at alternatives.

Yorgensen said that no alternatives were provided with this particular application.  She said that each submission has to stand on its own.

Metzler said that the more information is provided up front, the better.  The applicant asked what a successful application would look like, and Yorgensen replied that the applicant should look at the regulations and prove to the Commission that there are no feasible alternatives to this plan.  

There was a brief discussion about possibly having the house located in the front.  

Mr. Mihok said that once the driveway is installed, the area will be stabilized.

Metzler said that this application will be rescheduled for the June 23 meeting.

2.  File #W2003-19 – Application for a Single Family Dwelling in an upland area on
    property located at 46 Village Hill Road (Map 38, Lot 14, 1.4 acres).  
    Owner/applicant:  Richard and Donna Napolitano.  (Received 4/14/03; Decision by
    6/9/03.)

Mr. Mihok gave out revised plans.  He said that they are proposing a conversation easement 75 ft. wide along the DOT property and part of the DEP property and the steep slopes will be protected.  

Yorgensen said that Karl Acimovic has not reviewed the revised version yet.  

Drainage was discussed.  

Yorgensen said the applicant should seek an extension of time, and Mr. Mihok wrote out  permission for extension, which the applicant signed.

3.  Violation #W2003-01A – Village Hill Road Bridge Report.  Owner:  Town of
    Willington; Contractor:  PJF Construction; Gearoid Fitzgerald, 137 Somerset St.,
     West Hartford, CT.

Mr. Mihok gave some suggestions concerning drainage on the bridge.  There was discussion about the contractor depositing material (concrete, rock, etc.) on nearby property belonging to Joe Halchek.  Mr. Mihok said that planting has been done; Yorgensen said that they were supposed to come to us with a plan for the planting first.  Dirrigl commented that they are still working under a violation.

A site walk was set for Wednesday, June 11 at 8:30 a.m.  Yorgensen said that Mr. Acimovic and the clerk of the works should come out also.

4.  TruckCenters of America (the Lessee) and George Giguere of Royce Properties (the
    Owner) of property located at 327 Ruby road are in violation of the IWWC Act.

This matter was discussed.  A site walk was set for Wednesday, June 11, directly following the bridge walk.
